When you come to us with your bankruptcy concerns, our first step will be to fully explain the differences between Chapter 7 and Chapter 13, so that you can decide which course of action is best for you. The bankruptcy laws changed in 2005, making it more difficult for you to qualify for a discharge of your debts under Chapter 7.

Chapter 7 Filings

We will thoroughly examine your financial situation and run a preliminary means test to see if you qualify for a Chapter 7 filing. If you do, we will identify which debts may be discharged. Some obligations, including child support arrearages, student loans and certain tax debts, cannot be eliminated through bankruptcy. We will also make certain that any exempt assets, such as your primary residence and your vehicle, are excluded from sale in the bankruptcy proceeding.

Chapter 13 Representation

In a Chapter 13 proceeding, known as a reorganization, you agree to repay your creditors over a period of 3 to 5 years. We will review any proposed repayment agreements to make certain they are within your means.

Once we have identified which type of filing is best for you, we will help you complete and file the necessary paperwork. We will appear at all creditor creditor meetings on your behalf.
